Principal Employer  And Employer  Key Differences : 

1. Principal Employer

A Principal Employer is the main organization or authority for whom the work is being carried out through contract labour.

As per the Act:

The Principal Employer may be:

  • The owner or occupier of a factory
  • Head of department in government establishments
  • Manager or person responsible for supervision/control of establishment
  • Hospital management in case of corporate hospitals

Example:

In Kalinga Hospital:

  • The hospital/company management is the Principal Employer
  • If housekeeping, security, canteen, or manpower workers are hired through an outside contractor, the hospital remains the Principal Employer.

Main Responsibilities of Principal Employer

  • Obtain registration under the Act
  • Ensure contractor has valid labour licence
  • Ensure payment of wages to contract labour
  • Provide welfare facilities if contractor fails
  • Maintain statutory records
  • Liable for compliance in case contractor defaults

2. Employer

The word Employer is broader and generally means the person/entity directly employing workers.

Under contract labour arrangements, this usually refers to the Contractor who hires and supervises the workers.

Example:

If a security agency supplies guards to the hospital:

  • Security Agency = Employer/Contractor
  • Hospital = Principal Employer

Main Responsibilities of Employer/Contractor

  • Recruit contract labour
  • Pay wages
  • Maintain attendance, wage register, ESI, PF, leave records
  • Obtain labour licence
  • Ensure statutory compliance for workers deployed
